2. Applicability

These Terms of Service apply to all offers, orders, and agreements concluded through the Casa Verano website.

By placing an order, you declare that you agree to these terms.

3. Our Products

Casa Verano sells handmade home accessories and decorative products.

As our products are handcrafted and often made using natural materials, every item is unique. Minor variations in color, texture, finish, shape, or material are part of the artisanal nature of our products and do not constitute defects.

In particular, products containing natural materials, such as oyster shells, may differ from the photographs displayed on our website. We always strive to ensure that every product matches the product images and description as closely as possible.

4. Prices

All prices on our website are listed in euros (€) and include VAT unless stated otherwise.

Shipping costs are clearly displayed during checkout.

Casa Verano reserves the right to change prices at any time. Price changes will not affect orders that have already been confirmed.

5. Orders

After placing an order, you will automatically receive an order confirmation by email.

We reserve the right to refuse or cancel an order if:

a product is no longer available;
there is an obvious pricing or system error;
fraud is suspected;
incorrect or incomplete information has been provided.

If an order is cancelled after payment has been received, the full purchase amount will be refunded.

6. Payments

An order will be processed once payment has been successfully received.

7. Processing Time

As our products are carefully handmade and prepared, the following processing times apply:

Non-personalized products

Processing: up to 5 business days
Estimated delivery: within approximately 7 business days

Personalized products

Processing: up to 10 business days
Estimated delivery: within approximately 14 business days

During busy periods or due to unforeseen circumstances, these timeframes may be slightly longer. If this occurs, we will inform you as soon as possible.

8. Shipping

Orders over €50 qualify for free shipping.

We ship using:

Once your order has been shipped, you will receive a Track & Trace code where available.

Although we work carefully with our shipping partners, we cannot accept liability for delays occurring after a parcel has been handed over to the carrier.

9. Personalized Products

For personalized products, the customer is responsible for providing correct names, texts, or other personalization details.

Please check this information carefully before completing your order.

Personalized products cannot be returned unless:

the product was delivered damaged or defective;
Casa Verano made an error in the personalization;
a different product was delivered than the one ordered.

By placing an order, you also agree to that policy.

11. Warranty

Every Casa Verano product is handcrafted. As a result, each item is unique. Minor differences in color, shape, texture, finish, or natural materials (such as oyster shells, wood, or stone) are characteristic of our products and do not constitute defects.

You will always receive the type of product you ordered, although its appearance may vary slightly from the photographs on our website due to the use of natural materials.

In addition to your statutory warranty rights, we offer the following additional service.

If a product shows a manufacturing or quality defect within 30 days of delivery, please contact us at info@casaveranoliving.com or via the contact form on our website.

We will carefully assess each situation and work with you to find a suitable solution. Depending on the issue, we may repair the product, replace it with an equivalent handmade item, or, if this is not possible, issue a full or partial refund.

This additional service does not affect the statutory rights that consumers have under applicable law.

12. Intellectual Property

All content on this website, including texts, photographs, images, designs, logos, product descriptions, and other content, is the property of Bailey Summer Services trading as Casa Verano or is used with permission from the respective rights holders.

It is not permitted to copy, publish, or commercially use this content without prior written permission.

13. Liability

Casa Verano shall only be liable for direct damages resulting from an attributable breach of its obligations, to the extent permitted by law.

Our liability is limited to a maximum of the amount paid for the relevant order.

Casa Verano shall not be liable for:

indirect damages;
consequential damages;
loss of profits;
loss of data;
delays caused by carriers;
damage resulting from improper use of products;
damage resulting from force majeure.

These limitations do not apply where mandatory law provides otherwise.

14. Force Majeure

Casa Verano shall not be liable for delays or failure to perform its obligations where this results from circumstances beyond our reasonable control, including but not limited to:

natural disasters;
pandemics;
strikes;
war;
government measures;
carrier disruptions;
power or internet outages;
other events of force majeure.

15. Privacy

We process personal data solely in accordance with our Privacy Policy and applicable privacy legislation (GDPR).

16. Amendments

Casa Verano reserves the right to amend these Terms of Service at any time.

The most recent version will always be available on our website.

17. Governing Law

All agreements between Casa Verano and its customers shall be governed exclusively by the laws of the Netherlands.

Any disputes shall be submitted to the competent court in the Netherlands, unless mandatory law provides otherwise.
